These Terms of Service apply to the CarOfferly platform, owned and operated by OpenSource Autos LLC. By accessing or using CarOfferly, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
The service
CarOfferly lets you request an instant cash offer for your vehicle using tools and data provided through the platform, including third-party valuation providers. Offers are estimates based on the information you provide and current market data, and are not a guarantee of a final purchase price.
Eligibility
You must be at least 18 years old and legally able to enter into a contract to use CarOfferly. You agree to provide accurate, current, and complete information about yourself and your vehicle.
Offers and vehicle sales
Any offer presented is preliminary and subject to verification, inspection, and confirmation of your vehicle’s condition, title, and ownership. A final offer may differ from an instant estimate. Nothing on the platform constitutes a binding commitment to buy or sell until a separate agreement is signed.
Your responsibilities
- Provide truthful information about you and your vehicle.
- Use the platform only for lawful purposes.
- Do not attempt to disrupt, reverse-engineer, or misuse the platform.
Third-party tools and links
The platform uses and links to third-party services, including vehicle-valuation tools. We are not responsible for the content, accuracy, or practices of third parties, and their use may be governed by their own terms.
Communications
By submitting your contact information, you consent to receive communications from CarOfferly and OpenSource Autos LLC about your request, including by phone, text, and email, as described in our Privacy Policy.
Text messaging (SMS) terms
By opting in, you agree to receive recurring informational and promotional text messages from CarOfferly (OpenSource Autos LLC) regarding your vehicle offer, including offer updates, photo requests, and appointment reminders. Carriers are not liable for delayed or undelivered messages. You must be 18 years or older to opt in.
Disclaimers
The platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or that valuations will be accurate.
Limitation of liability
To the fullest extent permitted by law, OpenSource Autos LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Changes to these terms
We may update these Terms from time to time. Continued use of the platform after changes take effect means you accept the updated Terms.
